These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding agreement between the User (“You”, “Your”, “User”, “Customer”, “Attendee”) and FinkUP or FinkUP Entertainment Private Limited (“Company”, “Platform”, “We”, “Us”, “Our”), governing Your access to and use of the FinkUP website, mobile application, digital ticketing interfaces, and all services offered therein (“Services”).,By accessing, browsing, using, or registering on the FinkUP Platform, purchasing tickets, redeeming vouchers, using wallet services, scanning your ticket at the venue, or in any manner interacting with the Services, you acknowledge and affirm that:,You have carefully read and understood these Terms;,You voluntarily agree to be bound by these Terms without limitation or qualification;,You understand that these Terms form a binding contract enforceable under applicable law; and,You consent to electronic execution and acceptance of this Agreement.,If you do not agree to these Terms, You must immediately discontinue the use of the Platform and refrain from accessing any content, feature, or service provided by FinkUP.
1.2 Applicability of Terms
These Terms shall apply to:,Ticket discovery, booking, and purchase,Access to digital tickets, QR codes, entry credentials,Usage of FinkUP Wallet for event transactions,Promotional codes, offers, and incentives,Notifications, communications, and alerts,Event entry, admission privileges, and verification,Customer support interactions,Any other feature made available through the Platform,These Terms apply universally to all Users, irrespective of the method of access (web, mobile app, API-based services, or third-party embeds).
1.3 Amendments and Updates to Terms
FinkUP reserves the unilateral right to modify, revise, amend, update, or replace these Terms, wholly or in part, at any time and without prior notice. Such revisions may be necessitated by:,Changes in law or regulatory requirements,Platform upgrades and feature enhancements,Improvements in user experience,Operational necessities,Security and compliance obligations,Updated Terms shall be published on the Platform, and Your continued usage after such publication shall constitute deemed acceptance of the revised Terms. The responsibility to periodically review the Terms rests solely with the User.
1.4 Supplementary Policies
These Terms are to be read in conjunction with:,Privacy Policy,Refund & Cancellation Policy,Shipping & Delivery Policy,Event-Specific Terms (as applicable),Age-Restriction or Venue Policies,Any additional instructions provided on the Platform or at the venue,In the event of a conflict, unless explicitly stated otherwise, the provisions of these Terms shall prevail.
Failure by FinkUP to enforce any provision of these Terms shall not constitute a waiver of such provision, nor shall it impair the right to subsequently enforce the same.
1.6 Representation of Legal Capacity
By using the Platform, You represent and warrant that:,You are legally competent to enter into contracts;,You are not prohibited from using such services under applicable laws;,You are using the Platform for lawful purposes only;,You will comply with all conditions, policies, and instructions issued by FinkUP and Event Organisers.,If You are below the age of majority, You affirm that You are using the Platform under the supervision of a parent or legal guardian who accepts full responsibility for Your actions.
1.7 Nature of Role & No Agency
You expressly acknowledge that FinkUP acts solely as a technology intermediary facilitating the listing of events, ticket sales, and related digital services. FinkUP does not act as:,Event Organiser,Producer,Promoter,Venue owner,Artist manager,F&B provider,Vendor of goods or services at events,All responsibilities relating to event execution, safety, programme content, timings, logistics, and experience lie solely with the respective Event Organiser.
1.8 Continued Use as Acceptance
Every time You:,Access the Platform,Update Your profile,Book a ticket,Use a QR code for entry,Use the Wallet,Apply a promotional code,Interact with our Services,You reaffirm Your acceptance of these Terms.
1.9 Binding Effect on Successors
These Terms bind not only You but also:,Your legal heirs,Assigns,Representatives,Executors,Administrators,unless otherwise restricted by applicable law.
2. ELIGIBILITY, USER ACCOUNT, AND REGISTRATION REQUIREMENTS
2.1 Eligibility to Use the Platform
Use of the FinkUP Platform and its Services is permitted only to individuals who meet all of the following criteria:,Legal Capacity:
You must be competent to contract under the Indian Contract Act, 1872, meaning You are at least eighteen (18) years of age and not disqualified by any law from entering into binding contracts.,Geographic Eligibility:
The Platform is intended for Users located in India; however, Users accessing from outside India do so voluntarily and are responsible for compliance with local laws.,Non-Prohibited Person:
You must not be:,Barred by law from access to digital services;,Suspended or terminated previously by FinkUP;,Engaged in activities considered fraudulent, abusive, or harmful to the Platform.,Parental Consent:
If You are a minor or below the legal age required for event participation, a parent or legal guardian must supervise Your use and assume all responsibilities arising from such use.
2.2 Registration and Account Creation
To access certain features of the Platform-including ticket purchase, wallet usage, subscription features, or promotions-You may be required to create a User Account.,By registering, You agree to:,Provide accurate, current, and complete personal details including but not limited to:,Name,Mobile number,Email address,Age/Date of Birth,Any identification details required for event entry,Update such details from time to time to maintain accuracy.,Not create more than one (1) active User Account using the same identity or credentials.,Not circumvent Platform restrictions by creating duplicate or fraudulent accounts.,FinkUP reserves the right to request additional verification documents at any stage, including but not limited to: ID proofs, address proofs, demographic details, or any information required for statutory compliance.
2.3 Authentication and Security Obligations
You agree that:,Your login credentials (password, OTPs, device-linked authentication tokens) must be kept confidential, private, and secure.,You shall not allow any third party to access Your Account or impersonate You.,Any activity performed through Your Account shall be deemed to be performed by You.,You shall immediately notify FinkUP if:,Your password has been compromised,Your SIM card or email account is inaccessible,You suspect unauthorized Account access,Failure to notify FinkUP promptly may result in loss of access, invalidation of tickets, or wallet disputes for which FinkUP shall not be responsible.
2.4 Mobile Verification & Communication Consent
By registering on FinkUP, You consent to:,Receiving OTPs for login and verification;,Receiving transactional communications (SMS, WhatsApp, email, push notifications) related to:,Ticket confirmation,Entry instructions,Event updates,Wallet transactions,Refund status,Receiving promotional content unless explicitly opted out via available opt-out channels.,Transactional communications cannot be opted out of.
2.5 Responsibility for Account Activity
You expressly acknowledge and agree that:,You are solely responsible for all actions undertaken through Your Account;,FinkUP is not liable for any losses caused by unauthorized use of Your credentials;,Any misuse arising from shared login credentials, lost devices, or compromised emails/SIMs shall be Your responsibility;,FinkUP may suspend or terminate Your Account if suspicious or harmful activity is detected.
2.6 Prohibited Account Practices
The following practices are considered violations and may lead to account termination, suspension, or legal action:,Creating false identities or impersonating another person,Sharing accounts or login credentials,Using bots, automation tools, or scripts to book tickets,Manipulating wallet transactions,Abusing promotional codes,Attempting access to restricted platform areas,Re-registering after suspension or termination without permission
2.7 Temporary or Permanent Account Suspension
FinkUP may suspend or terminate Your account, without prior notice, for reasons including but not limited to:,Fraudulent activities,Abusive behavior,Security risks,Chargeback disputes,Breach of these Terms,Regulatory or legal requirements,Misuse of tickets, wallets, or platform features,Multiple failed authentication attempts,During investigation, FinkUP may:,Freeze wallet balances,Invalidate pending transactions,Block future purchases,Withhold access to tickets
2.8 Data Accuracy & Consequences of Incorrect Information
You agree and understand that:,Incorrect email/mobile details may prevent ticket delivery;,Incorrect age or identity details may result in entry denial;,Incorrect data may affect refund status;,FinkUP is not liable for losses arising from incorrect user information.,Event Organisers may require valid ID proof at the venue. Any mismatch may lead to non-admission without refund.
2.9 Account Termination by User
You may request account deletion by contacting support. Upon deletion:,You lose access to all prior purchases;,Tickets linked to Your Account may be invalidated.,Wallet balance handling will follow the Refund and Wallet Policy;,Some data may be retained for compliance and audit requirements.
3. EVENT LISTINGS, DESCRIPTIONS, REPRESENTATIONS & PLATFORM ROLE
All events displayed, promoted, described, or otherwise made available for booking on the FinkUP Platform (“Event Listings”) are listed solely by the respective Event Organisers.
FinkUP functions exclusively as a technology intermediary that facilitates:,Display of event details,Ticket discovery,Ticket purchase mechanisms,Digital delivery of passes,Wallet usage at events,Entry management and related digital experiences,FinkUP does not independently verify, audit, or certify any event Listing or Organiser representation.
3.2 Organiser Responsibility for Event Information
The Organiser is exclusively responsible for ensuring that all event information provided on the Platform is:,Accurate,Complete,Up to date,Lawful,Non-misleading,This includes, without limitation:,Event title & category,Date & time of the event,Venue details & seating arrangements,Artist/performer lineup,Schedule, program, and format,Terms of entry, age restrictions,Pricing, category descriptions, and inclusions,Safety, access, and disability policies,Promotional content and disclaimers,Any benefits or entitlements associated with ticket categories,FinkUP does not warrant the accuracy or completeness of the content supplied by Organisers and is not liable for any discrepancies.
3.3 No Endorsement or Verification by FinkUP
You expressly acknowledge that FinkUP:,Does not produce, organize, or manage events,Does not endorse any Organiser, artist, performer, or venue,Does not guarantee the authenticity, suitability, safety, or legality of any event,Does not verify the capability, conduct, intent, or reliability of Organisers,Does not edit or preview Organiser-provided content except as necessary for formatting and compliance,All decisions to attend an event rely solely on Your personal judgment.
3.4 Changes to Event Information
Event details may be modified by the Organiser at any time prior to or during the event due to circumstances including but not limited to:,Operational constraints,Technical issues,Weather,Artist availability,Government directives,Venue capacity or safety considerations,Such changes may include:,Time changes,Venue shifts,Zone reallocation,Partial or full lineup modifications,Adjustments in seating arrangements,Alteration of entry gates or protocols,FinkUP is not liable for consequences of such changes.
3.5 Availability of Seats & Inventory Control
Ticket inventory, seating capacity, and category allocation are controlled entirely by the Organiser.,Seats may fill quickly; FinkUP does not guarantee availability at any time.,The Platform’s indication of availability is subject to real-time updates and technical limitations.,Inventory may vary due to:,Offline sales by the Organiser,Allocation changes,Venue restrictions,Technical delays in updates,FinkUP bears no responsibility for inventory exhaustion or unavailability.
3.6 Accuracy of Pricing & Representations
The Organiser is responsible for setting ticket prices, including:,Base price,Taxes,Surcharges,Convenience fees,Category-specific pricing,Promotional or discounted rates,FinkUP displays prices as provided but does not warrant:,Freedom from typographical errors,Accuracy of inclusions,Stability of pricing,Where obvious pricing or category errors are detected, FinkUP reserves the right to:,Cancel bookings,Issue refunds,Adjust erroneous listings,Consult with the Organiser for corrective action
3.7 Third-Party Images, Artwork, Descriptions & Media
Event pages may contain:,Photos,Artwork,Illustrations,Venue maps,Promotional videos or reels,Artist images,All such media is supplied by Organisers or third-party licensors.
FinkUP is not responsible for:,Misleading graphics,Outdated visuals,Incorrect seating illustrations,Promotional exaggerations,Event experience may differ from imagery used.
3.8 Restrictions, Rules & Additional Conditions
Events may impose:,Age limits,Gender-specific entry rules,Dress codes,Prohibited item lists,Behavorial obligations,Special access conditions,Alcohol policies,ID verification requirements,Medical or security checks,Photography restrictions,FinkUP displays these rules when provided, but the Organiser remains solely responsible for enforcing them.,Users are responsible for reviewing all event-specific rules prior to booking.
3.9 Event Safety & On-Ground Standards
Event safety measures-including but not limited to:,Crowd control,Medical facilities,Emergency evacuation,Fire compliance,Security personnel deployment,Entry/exit gate management,are entirely under the Organiser’s control.,FinkUP does not:,Conduct safety audits,Inspect venues,Guarantee adequacy of safety arrangements,Provide on-ground management unless explicitly contracted (not relevant for public T&C),Incidents relating to safety, injury, harassment, or crowd management are outside FinkUP’s scope and liability.
3.10 Temporarily Unavailable Listings
FinkUP may temporarily restrict access to event listings due to:,Technical maintenance,Organiser configuration updates,Legal or regulatory requests,Corrective actions for inaccurate information,Sudden inventory changes,Such unavailability does not constitute a service failure.
3.11 Errors, Omissions & Inaccuracies
While FinkUP exercises reasonable diligence in platform operation, You acknowledge that:,Event information may contain errors or omissions,Updates provided by Organisers may be delayed,Visuals may be symbolic,Category descriptions may vary in interpretation,Seat maps may not reflect real-time changes,FinkUP shall not be liable for losses arising out of such inaccuracies.
3.12 No Guarantee of Event Occurrence
FinkUP does not guarantee that:,The event will take place as scheduled,Artists or performers will appear,Programs will be executed in full,Event quality will meet User expectations,The event will not be cancelled or postponed,Your decision to book tickets is made voluntarily, and at Your own risk.
3.13 Organiser Liability and Platform Role Clarification
You acknowledge and agree that:,All event-related obligations lie solely with the Organiser,FinkUP’s responsibility is limited to facilitating digital transactions,FinkUP is not responsible for Organiser insolvency, misconduct, or operational failure,Complaints regarding event content, safety, amenities, or execution must be directed to the Organiser
3.14 Suspension or Removal of Events
FinkUP reserves the right to:,Remove event listings,Suspend ticket sales,Block Organiser access,Alter or restrict booking flow,if an Organiser:,Violates laws or platform policies,Provides inaccurate or harmful event information,Fails to maintain necessary permits,Poses a risk to Users or public safety,Such removal does not create liability for FinkUP.
By booking an event, You explicitly acknowledge that:,You rely solely on Organiser-provided information,FinkUP does not validate the authenticity of event content,Attendance at an event is at Your own risk,Organiser decisions regarding entry, refunds, schedule, or lineup changes are final and binding
4. TICKET PURCHASE, PRICING, FEES, PAYMENT TERMS & ORDER CONDITIONS
This section governs the rules applicable to the purchase of tickets, passes, wristbands, or any access credentials through the FinkUP Platform.
4.1 Offer to Purchase & Acceptance
When You initiate a ticket purchase on FinkUP:,You submit an offer to buy the ticket(s) at the price and terms displayed.,FinkUP forwards the offer to the respective Organiser.,The booking is confirmed only when:,Payment is successfully processed,,A unique Booking ID is generated,,The electronic ticket / QR code / wristband confirmation is delivered to You.,FinkUP reserves the right to reject or cancel any order before confirmation without providing a reason.
4.2 Pricing Structure & Components
Ticket prices displayed may include some or all of the following:,Base Ticket Price - set solely by the Organiser.,Government Taxes & Levies - including GST or entertainment tax.,Convenience Fee / Platform Fee - charged by FinkUP for enabling digital services.,Payment Gateway Charges - as applicable based on payment method.,Venue Charges / Facility Fees - levied by Organiser or venue.,Add-on Purchases - such as merchandise, food vouchers, parking passes, priority entry, etc.,All fees are disclosed at checkout prior to payment.
Certain events may utilize dynamic pricing models wherein the ticket price fluctuates based on:,Demand,Inventory availability,Time remaining until event start,Organiser-defined algorithms,FinkUP is not responsible for price changes before or after Your booking.,No price adjustment will be made once a booking is confirmed.
4.4 Currency & Payment Instruments
Payments may be accepted through:,UPI,Debit/Credit Cards,Net Banking,Wallets,EMI or BNPL options (if supported),Other payment instruments enabled from time to time,All payments must be made in Indian Rupees (INR) unless explicitly specified otherwise.,International cardholders acknowledge that foreign exchange charges may apply as per their bank’s policies.
4.5 Payment Failures & Partial Success
A booking may fail due to:,Connectivity issues,Payment gateway errors,Bank-side failures,Timeouts,Incorrect user inputs,In such cases:,If payment is deducted but booking fails:
The amount will be reversed by the bank/payment gateway within the timelines prescribed by their policies.
FinkUP DOES NOT control or influence refund timelines for failed transactions.,If booking is partially processed:
FinkUP may cancel the incomplete order and initiate refund of the deducted amount where appropriate.,Users must not raise duplicate disputes or chargebacks for transactions still being processed.
Tickets are delivered digitally via:,Email,SMS,Mobile app,WhatsApp (if enabled),Wallet passes,Box office collection or venue wristband pickup (for certain events),The User is responsible for:,Providing correct email and phone details,Checking spam/junk folders,Ensuring device compatibility to display tickets,Preserving QR codes from unauthorized misuse,Non-receipt due to incorrect details or device issues is not the responsibility of FinkUP.
4.7 Quantity Restrictions
Organisers or FinkUP may impose limitations on:,Maximum tickets per transaction,Total tickets per user,Limits on premium or discounted categories,Restrictions for resale prevention,FinkUP may cancel tickets purchased in violation of such restrictions without prior notice.
4.8 Ticket Validity & Barcode/QR Requirements
A ticket is valid only if:,It carries a unique QR/barcode issued by FinkUP,It has not been tampered with, duplicated, altered, or shared,It is presented in readable condition at the venue,Any misuse or unauthorized reproduction may lead to:,Entry denial,Account suspension,Legal action,FinkUP shall not be liable for losses arising from shared, leaked, or screenshot ticket codes.
4.9 No Transfer, Resale, or Commercial Use
Unless explicitly permitted:,Tickets purchased through FinkUP are personal, non-transferable, and not for resale.,Scalping, black-market sales, premium resale, or speculative purchases are strictly prohibited.,Users may not use tickets for promotional, commercial, or brand-related activities.,FinkUP may cancel tickets found to be resold or misused.,No refunds shall be issued for such cancellations.
4.10 Errors, Inaccuracies & Right to Cancel
FinkUP reserves the right to cancel or amend any booking in case of:,Pricing errors,Category misconfiguration,Seat map inaccuracies,Duplicate orders,Technical system faults,Organiser data errors,Refunds, where applicable, will follow Organiser policy.
4.11 Order Confirmation & Contract Formation
A contract between You and the Organiser is deemed formed when:,FinkUP processes Your payment,,Generates a Booking ID, and,Delivers the ticket.,FinkUP is NOT a party to that contract; it is merely the facilitator.
4.12 Right to Refuse Service
FinkUP reserves the right, at its sole discretion, to:,Reject orders,Limit bookings,Block suspicious activity,Flag fraudulent accounts,Prevent payment completion,Reasons may include:,Multiple failed payment attempts,High-risk behavior,Chargeback history,Automated booking patterns,No explanation may be provided for such refusal.
4.13 Multiple Orders & Duplicate Bookings
Users must verify their booking history to avoid duplication.,FinkUP is not liable for:,Duplicate orders caused by User error,Accidental double-clicks,Multi-device simultaneous booking attempts,Payment retries without checking order status,Refunds for duplicates depend solely on Organiser approval.
4.14 Ticket Add-Ons, Merchandise & Ancillary Purchases
Certain events may allow add-on purchases such as:,Merchandise,Parking,Food vouchers,VIP upgrades,Seating privileges,Priority entry,Such products are provided entirely by the Organiser or certified partners.,FinkUP does not guarantee:,Availability,Quality,Warranty,Fitness for purpose,Refund of add-ons is strictly governed by Organiser policy.
4.15 Taxes, Surcharges & Additional Levies
The User acknowledges that:,Taxes may be revised at any time by authorities,Surcharges or cess may apply depending on state laws,Organisers may adjust ticket components due to governmental requirements,FinkUP shall not be liable for increases in tax or levy after booking.
4.16 Abandoned Transactions / Pending Payments
If a transaction remains pending or incomplete:,FinkUP may auto-cancel the order,Reserved seats may be released,Promotional codes may not be reusable,Partial data entries may be cleared,The User must complete payment within the time window indicated.
4.17 No Guarantee of Continuity or Booking Completion
At peak demand or during limited releases (festivals, concerts, premium events):,High traffic may cause slowdowns,Payment gateway overload may occur,Inventory may sell out during checkout,FinkUP does not guarantee that initiating payment ensures a confirmed booking.
4.18 Representation of User Authority
By purchasing tickets, You represent that:,You are authorized to use the payment instrument,You are purchasing tickets for lawful personal use,You will not use tickets for unauthorized trading or profit-making,Use of stolen or fraudulent payment instruments may result in legal action.
4.19 Finality of Completed Orders
Once a booking is confirmed:,Orders cannot be changed, modified, or exchanged,Tickets cannot be upgraded or downgraded,Category switches are not permitted unless Organiser approves,Name changes may not be possible for certain events,You must review order details carefully before payment.
5. DELIVERY OF TICKETS, ACCESS CREDENTIALS & USER RESPONSIBILITY
This section governs how digital tickets, QR codes, wristbands, passes, and all access credentials (“Access Credentials”) are delivered, stored, retrieved, and used by You for event entry.
Upon successful booking, Access Credentials may be delivered through one or more of the following channels, depending on event configuration:,Email Delivery
A digital ticket or QR code will be sent to the email address provided at the time of registration or purchase.,SMS/WhatsApp Delivery
A link to download or view Your ticket may be sent to the registered mobile number.,FinkUP Mobile Application
Tickets may be accessible within the “My Tickets” or profile section of the app.,Wallet/Passbook Integration
Certain events may allow adding tickets to digital wallets (e.g., Apple Wallet, Google Wallet).,Box Office Collection
In select events, You may be required to collect physical tickets or wristbands from the venue box office.,Venue Wristband Pickup
Some festivals/concerts issue RFID/NFC wristbands as the primary Access Credential, which replace digital tickets.,Delivery method is determined by the Organiser, not FinkUP.
5.2 Accuracy of Contact Information
Delivery is strictly dependent on:,Accuracy of the mobile number,Accuracy of the email ID,Functionality of Your mailbox or SMS network,Device compatibility,FinkUP is not responsible for:,Failed delivery due to incorrect information,Blocked SMS/Email by device settings or spam filters,Delayed delivery due to network congestion,User’s inability to access registered email/SIM,You must ensure all details are correct prior to booking.
5.3 Ticket Non-Receipt & Retrieval Options
If You do not receive Your ticket due to network or device issues:,You may retrieve it through:,“My Tickets” section of the FinkUP app,Re-sending the ticket from FinkUP’s website,Contacting FinkUP Support with Booking ID,Presenting valid identification at the venue for box office issuance (if allowed),Organiser rules supersede FinkUP capabilities in reissuing lost tickets.
5.4 Unique QR/Barcode Requirement
Each ticket issued includes a unique, encrypted QR code or barcode, which is required for entry.,You acknowledge that:,The QR code must be clearly visible and scannable.,Screenshots may be invalid if Organiser disallows them.,A damaged, blurred, or illegible code may result in denial of entry.,Sharing Your QR code with others creates a risk of fraud.,The first scan at the venue may invalidate the remaining duplicate copies.
5.5 Responsibility for Safekeeping
You are solely responsible for:,Maintaining confidentiality of QR codes,Preventing unauthorized access to Your email/app,Keeping wristbands intact and not tampered,Ensuring Your device is charged and functional,Safely storing any physical tickets provided,FinkUP is not liable for:,Unauthorized duplication,Misuse by third parties,Loss due to shared screenshots,Tampering of wristbands,Device failure at entry gate,Entry cannot be guaranteed if the credential has been previously used or compromised.
5.6 Device Requirements & Technical Compatibility
You agree that:,A functioning smartphone with adequate brightness is required for scanning at some venues.,Some events may require the FinkUP mobile app for entry.,You must ensure stable internet or pre-download the ticket.,Certain digital formats may not open on outdated browsers, unsupported devices, or modified operating systems.,FinkUP is not liable for entry issues caused by:,Device malfunctions,Low battery,Unsupported file viewers,Corrupted storage,Deleted email or SMS content
5.7 Box Office Issuance & Identity Verification
For events requiring on-site ticket pickup or wristband collection, You may need to produce:,Government-issued photo ID,The credit/debit card used for booking,Printed or digital Booking ID,Signed authorization in case of third-party pickup,Failure to provide required documents may result in refusal of issuance without any refund.
5.8 Wristband Policies (RFID/NFC/Access Bands)
For multi-day or premium events, wristbands may be mandatory. You acknowledge that:,Wristbands serve as both identity and access proof.,Damaged, tampered, cut, or removed wristbands are automatically invalid.,Replacement of wristbands is controlled solely by the Organiser and may incur charges.,RFID-based wallets or stored value linked to wristbands are subject to event-specific rules.,Wristbands must not be transferred, exchanged, or sold.,FinkUP shall not be responsible for:,Lost wristbands,Fraudulent swapping,Denied access due to tampering,Failure of RFID systems due to environmental or venue conditions
5.9 Multi-Ticket Purchases & Group Bookings

5.11 Event-Specific Delivery Conditions
Certain events may impose additional requirements:,Mandatory app download to access QR code,ID-linked tickets that cannot be transferred,Face recognition–based entry (with pre-consent),Timed release of access credentials,Mandatory pre-registration forms,Digital KYC for premium or restricted events,Users must comply with event-specific delivery rules displayed during purchase.
5.12 Corrections & Updates to Delivery Information
FinkUP may allow users to update:,Email address,Mobile number,Name spelling,Minor ticket details,However, such changes:,Are subject to Organiser approval,May not be available for all events,Are not guaranteed,May be rejected due to policy restrictions,Incorrect information at the time of purchase is solely the User’s responsibility.
5.13 No Liability for Third-Party Failures
FinkUP is not responsible for failures attributable to:,Telecom providers,Email service providers,Mobile device limitations,User’s inbox storage limits,WhatsApp/SMS filtering,Third-party hardware/software issues,Users must contact respective service providers for such failures.
5.14 Retrieval of Tickets on Event Day
If You arrive without a ticket:,FinkUP may assist through:,App-based ticket retrieval,Re-sending links,Customer support channels,But entry is not guaranteed if:,Network is unstable,Identity mismatch occurs,Organiser disallows on-site retrieval,Box office is closed or restricted,This is not a FinkUP-controlled process.
By booking a ticket, You acknowledge that:,Ticket delivery is a digital service dependent on third-party infrastructure,FinkUP has no liability for loss, theft, or unauthorized access,You must safeguard Your credentials responsibly,Entry denial arising from delivery issues attributable to the User does not warrant a refund
6. ENTRY TO EVENTS, ADMISSION RULES, VENUE POLICIES & ORGANISER RIGHTS
This section governs Your rights and obligations when entering any event for which a ticket is purchased through FinkUP.,Entry to any event is not guaranteed solely by purchase of a ticket; it is subject to compliance with all event, venue, legal, and safety rules.
6.1 Organiser and Venue Control Over Admission
You acknowledge that:,Admission to the venue is controlled entirely by the Event Organiser and/or venue authorities.
FinkUP does not control, supervise, or influence entry decisions.,The Organiser and venue reserves the absolute right to:,Deny entry,Delay entry,Conduct security checks,Restrict access to certain zones,Remove attendees from the venue,Admission may be denied for reasons including but not limited to:,Invalid, tampered, screenshot, or previously used QR codes,Misconduct, intoxication, aggressive behaviour,Violation of event rules or dress code,Suspicious or unsafe behaviour,Safety concerns or capacity restrictions,Missing or mismatched identity documents,Carrying prohibited items,Failure to comply with staff instructions,No refund shall be issued if entry is denied for any reason attributable to the User.
6.2 Security Checks & Mandatory Screening
By attending the event, You consent to:,Physical frisking,Bag checks,Metal detectors,Scanners & magnetometers,Alcohol breath tests (if applicable),ID verification,Age verification,Biometric/face match verification where pre-consent is given,Refusal to comply with any security requirement will result in denial of entry.,Security protocols may be mandated by:,Venue,Organiser,Local police,Fire & safety authorities,Government regulations,FinkUP shall not be liable for security-related decisions.
6.3 Prohibited Items and Behaviours

6.7 Alcohol Consumption, Intoxication & Substance Restrictions

6.8 Safety, Conduct & Compliance Obligations
You agree to:,Follow all instructions from security staff and venue authorities,Not obstruct emergency exits,Not engage in unsafe behaviours,Not compromise safety protocols,Cooperate during emergency evacuations,Respect seating and zone restrictions,Any breach may lead to expulsion without refund.
6.9 Event Layout, Seating & Zone Access
Venue layout, seating arrangements, and zone access are determined solely by the Organiser.,Users acknowledge:,Actual seating/standing space may differ from maps shown online.,Organisers may modify or reallocate zones due to operational reasons.,Zone upgrades or downgrades are not FinkUP’s responsibility.,Access to premium, VIP, VVIP, or restricted areas requires appropriate credentials.,FinkUP is not liable for any inconvenience arising from layout modifications.
6.10 Special Entry Formats (RFID, Face ID, App-Pass)
Some events may use advanced entry formats such as:,RFID wristbands,NFC-enabled passes,Facial recognition-based entry (subject to user consent),In-app QR tokens,Users must comply with all technical and operational requirements.
Failure to opt-in or complete pre-event setup may result in delayed or denied entry.
The Organiser or venue may remove any attendee who:,Violates event rules,Causes disturbance,Engages in illegal activity,Endangers safety,Refuses security instructions,Harasses staff or other attendees,Damages property,No refund or compensation shall be provided.
6.12 Liability for Personal Belongings
You are solely responsible for the safety of Your belongings.,FinkUP does not provide:,Cloakroom services,Storage lockers,Bag management facilities,FinkUP is not liable for:,Lost items,Stolen items,Damaged personal belongings,Items confiscated at security check
6.13 Force Majeure & Mandatory Venue Closures
Events may be affected by:,Weather conditions,Government orders,Public safety directives,Curfews,Natural disasters,Law & order situations,Entry restrictions or closures required due to force majeure events do not entitle Users to refunds unless the Organiser decides otherwise.
6.14 Compliance with Laws
You agree to comply with:,Venue laws,Local municipal regulations,Public gathering rules,Safety norms,Fire code standards,Violation may lead to denial of entry.
6.15 Final Authority of Organiser and Venue
Organiser and venue decisions regarding:,Admission,Seating,Alcohol policies,Dress code,Behavioural conduct,Safety compliance,are final and binding.,FinkUP cannot overturn or influence such decisions.
7. EVENT CHANGES, RESCHEDULING, CANCELLATIONS & POSTPONEMENTS
Event schedules, performers, venues, and other event attributes are subject to change at the sole discretion of the Organiser. FinkUP acts only as an intermediary and bears no responsibility for such modifications.
7.1 Organiser’s Absolute Right to Modify Event Details
You acknowledge that the Organiser has the full and absolute right to:,Change event date or timing,Alter the venue or layout,Modify seating or zone allocations,Change performers, speakers, artists, or lineup,Adjust the duration, agenda, or flow,Introduce new restrictions or conditions for entry,Modify event format (e.g., convert standing to seating, or vice versa),Reduce capacity based on safety or regulatory requirements,Such modifications do not entitle the User to a refund unless explicitly permitted by the Organiser’s policy.
7.2 Rescheduling of an Event
If an event is rescheduled:,Tickets already purchased shall ordinarily remain valid for the new date.,Users shall be informed via registered email/mobile.,No refund shall be issued solely because of a date change unless:,The Organiser explicitly permits refunds, or,A state law mandates a refund for such cases.,FinkUP cannot override the Organiser’s decision.,Users who are unable to attend the rescheduled event shall follow the Organiser’s refund rules.
7.3 Venue Change or Layout Modifications
If the venue is changed:,Tickets remain valid for the new venue.,Seating/zone categories may be adjusted by the Organiser.,Equivalent or reasonably similar seating may be assigned.,If the Organiser modifies seating layouts due to operational, safety, regulatory, or technical reasons:,Such changes do not qualify for refunds.,Allocation of alternate seats or zones is at Organiser’s discretion.,FinkUP shall not be liable for dissatisfaction with modified layouts.

7.5 Cancellation of an Event by the Organiser

7.6 Partial Cancellations, Stoppage, or Suspension During Event
An event may be partially cancelled or stopped due to:,Weather conditions,Technical failures,Sound or light issues,Safety hazards,Crowd behaviour,Law enforcement orders,If the event is terminated mid-way:,Users may not be entitled to refunds unless the Organiser announces otherwise.,FinkUP shall follow the Organiser’s refund decision strictly.
7.7 Postponement Due to Force Majeure

7.8 Technical or Operational Failures During Event
Examples include:,Sound system failure,Lighting failure,Video/AV malfunctions,Stage issues,Delays in artist set,Generator or backup failure,These do not qualify for refunds unless the Organiser explicitly agrees.
7.9 Dissatisfaction With Event Quality
User dissatisfaction due to:,Performance quality,Setlist choices,Duration of act,Stage visibility,Seating comfort,F&B quality or pricing,Parking availability,Crowd management,Delays in start time,Venue hygiene,does not entitle the User to any refund or compensation.,FinkUP makes no warranties regarding event experience.
7.10 Refunds When Permitted by Organiser

7.11 No Show, Late Arrival & Entry Refusal

7.13 Organiser’s Decision is Final
Organiser decisions regarding:,Refund eligibility,Classification of cancellations,Validity of tickets,Nature of rescheduling,Extent of refunds,Venue or layout changes,Definitions of Force Majeure,are final and binding on FinkUP and all Users.
7.14 FinkUP’s Liability Limitation for Event Modifications
FinkUP’s role is limited to facilitating ticket transactions.,FinkUP shall not be liable for:,Cancellations, postponements, or amendments,Organiser or venue non-performance,Event delays or disruptions,Costs incurred by Users (travel, stay, food, etc.),Any loss of enjoyment or dissatisfaction,Damages arising from reliance on event details,Your sole remedy, if any, lies with the Organiser as per their policy.
7.15 Communication of Changes
FinkUP will make reasonable efforts to communicate changes as soon as officially informed by the Organiser through:,Email,SMS,App notifications,Platform updates,However, failure to receive or read such communication does not entitle the User to compensation.
8. REFUNDS, CANCELLATIONS & NON-REFUNDABLE COMPONENTS
Refunds and cancellations for tickets purchased through FinkUP are governed entirely by the Event Organiser’s refund policy. FinkUP is solely a facilitator of ticket transactions and shall not be held liable for refund decisions taken by Organisers.
8.1 General Rule: All Sales Are Final
Unless explicitly stated otherwise by the Organiser for a specific event, all ticket purchases are final, non-cancellable, non-transferable, and non-refundable.,Users acknowledge that:,Tickets once sold cannot be cancelled by the User.,Tickets cannot be exchanged for another event.,No modifications or partial cancellations are permitted.,Mistakes made by Users during booking do not qualify for refunds.,This rule forms the foundational commercial basis of ticketing operations.
8.2 Refunds Only When Organiser Approves
Refunds may only be issued when the Organiser:,Cancels the event, and/or,Formally instructs FinkUP to initiate refunds, and/or,Provides written authorization for refunds in exceptional circumstances, and/or,Configures refund eligibility for specific categories or ticket types.,FinkUP cannot independently approve refunds or override Organiser decisions under any circumstance.
8.3 Non-Refundable Components

8.6 Refund to Wallet or Credits
Organisers may choose to provide refunds as:,Event credits,Platform wallet balance,Vouchers redeemable for future events,Such credits:,May have expiry dates,Are non-transferable,Cannot be encashed,Must be used as per terms defined by Organiser,FinkUP merely facilitates issuance of such credits.
8.7 Refund Verification & Fraud Checks

8.8 Chargebacks & Disputes

8.10 Failure of Refund Due to User Error

8.11 Refunds in Case of Split Payment or EMI

8.16 No Compensation for Ancillary Expenses

8.17 Communication of Refund Status

9. USER CONDUCT, PROHIBITED BEHAVIOUR & PLATFORM MISUSE
By using FinkUP and attending events for which tickets are purchased through the Platform, You agree to comply with all behavioral, safety, operational, and legal standards defined herein.,Non-compliance may result in:,Account suspension,Ticket invalidation,Wallet freeze,Denial of entry,Removal from venue,Legal action,Permanent ban
9.1 General Standards of Conduct
You agree to:,Use the Platform only for lawful purposes;,Provide accurate and truthful information;,Follow instructions of venue authorities, event staff, and security personnel;,Treat all staff, performers, and attendees with respect;,Refrain from disruptive, unsafe, or offensive behavior;,Not engage in harassment, intimidation, or violence;,Not engage in fraudulent, abusive, or manipulative conduct;,Use FinkUP-provided tickets and credentials responsibly and ethically.
9.2 Prohibited Activities on the Platform
You are strictly prohibited from engaging in the following activities:,A. Fraudulent Activities,Using stolen payment instruments,Misrepresenting identity,Creating fake/multiple accounts,Chargeback abuse,Submitting fraudulent refund requests,Attempting to bypass payment verification,Manipulating ticket quantities or inventory,B. Unauthorized Access,Using scripts, bots, crawlers, or automated tools,Hacking, tampering, or interfering with Platform operations,Circumventing authentication or access mechanisms,Attempting to gain access to administrative systems,C. Scalping & Unauthorized Resale,Reselling tickets at higher prices,Bulk buying of tickets for black-market distribution,Purchasing tickets for speculative or commercial resale,Using third-party resale platforms without Organiser approval,Violations may lead to permanent blacklisting.,D. Misuse of Promotional Offers,Exploiting coupons by multiple account creation,Using referral codes fraudulently,Redeeming offers not intended for You,Attempting to manipulate discount structures,E. Data Misuse,Scraping user or event data,Harvesting email or phone numbers,Misusing attendee information obtained from the Platform,F. Uploading Harmful Material,Viruses, malware, worms, trojans,Infringing content,Obscene or defamatory material,False or misleading information,G. 9.3 Prohibited Behavior at Events
The following behaviors are strictly forbidden at any venue:,A. Safety Violations,Blocking emergency exits,Pushing, shoving, or creating crowd surges,Participating in unsafe actions or stunts,Throwing objects or engaging in violence,B. Intoxication & Substance Use,Being under the influence of drugs,Excessive alcohol consumption,Possession or use of illegal substances,Supplying alcohol to minors,Entry or continuation of stay may be denied without refund.,C. You are strictly prohibited from:,Sharing QR codes publicly or privately,Taking screenshots and distributing them,Attempting multiple entries using the same credential,Altering or modifying QR/barcode content,Tampering with RFID/NFC wristbands,Fabricating false access credentials,Any such misuse results in:,Immediate entry denial,Ticket invalidation,No refund,Account termination
9.5 Restrictions on Digital Interactions
You shall not:,Use the Platform for solicitation or advertising,Promote illegal activities,Spread misinformation,Conduct unauthorized surveys or data collection,Post offensive or harmful comments,Spam ticket reviews or chat sections,FinkUP reserves the right to moderate or remove any user-generated content.
9.6 Interference with Venue Operations
Users may not:,Interfere with security processes,Attempt to influence event staff decisions,Engage in bribery,Violate queueing protocols,Attempt unauthorized crowd movement,Damage venue property or equipment,Any damages caused by the User shall be recoverable by the Organiser under applicable law.
9.7 Fraud Detection & Automated Monitoring

22.8 Digital Redemption Limitations at Venues
Digital systems at venue gates may be impacted by:,Device-to-device interference,Overloaded entry gates,Weak venue WiFi,Environmental lighting conditions,Sound/tech equipment interference,Gate staff handling,This may cause:,Temporary delays,Need for manual override,QR rescanning attempts,Slower processing,These do not qualify for refund or compensation.
22.9 Contactless Entry & Health/Safety Policies
Digital ticketing aligns with:,Health guidelines,Reduced physical contact,Fast entry systems,Touch-free verification,However:,Venue security may still need physical inspection,Bags may require manual check,Identity documents may still need to be shown,Digital-only entry does not eliminate venue safety protocols.
22.10 Event-Specific Digital-Only Requirements
Certain events may explicitly require:,Mandatory FinkUP app download,Mandatory digital wallet linkage,Mandatory FR enrollment,Mandatory wristband activation,Mandatory QR refresh,Mandatory ID matching via app,Failure to follow instructions may lead to:,Entry denial,Requirement to visit box office,Delay at gate,Additional verification,These are Organiser-driven rules, not FinkUP’s.
22.11 Eco-Friendly “Green Ticketing” Disclaimer
For events adopting eco-policy:,Paper tickets may be completely eliminated,Physical brochures, guides, or maps may be unavailable,Digital alternatives may be provided via app or QR guides,You acknowledge that:,FinkUP supports eco-friendly initiatives,Users must adapt to paperless systems,Digital-only policies do not create liability
22.12 Loss of Digital Access Credential
If You lose access to Your digital ticket because:,You deleted the app,You logged out of Your account,You lost Your phone,Email was erased,Device malfunctioned,You may recover it only through:,Login to FinkUP account,Proof of identity (if required),Organiser-approved box office reissue,Refunds will not be issued for loss of access arising from User-side issues.
22.13 Digital-Only Events with Zero Offline Support
Some events may explicitly state:,“No physical tickets. No offline redemption. Digital-only.”,In such cases:,Access cannot be obtained without a functioning digital pass,Organisers and FinkUP will not issue paper backups,Box office support may be limited or unavailable,Users must ensure:,Proper device readiness,Updated app,Correct login credentials
22.14 User Acknowledgment
By attending events using digital or contactless ticketing, You expressly agree that:,Digital-only access is the event’s operational standard,FinkUP is not liable for technical or device failures,Refunds will not be granted for inability to present valid digital credentials,Wristbands and digital passes are User’s responsibility,Tokenized QR, NFC, and other systems may have operational limitations
23. INTELLECTUAL PROPERTY RIGHTS
This section governs all intellectual property (“IP”) associated with the FinkUP Platform, including but not limited to:,Technology,Code,Designs,UI/UX components,Brand assets,Content,Algorithms,Ticketing protocols,Device integration logic,Documentation,APIs,Infrastructure,You acknowledge that all IP rights in and to the Platform are the exclusive property of FinkUP Private Limited and its licensors.
23.1 Ownership of Platform & Technology
All technology underlying the FinkUP ecosystem, including but not limited to:,Mobile and web applications,Software code (frontend, backend, APIs),Ticketing engines,QR/NFC/RFID access systems,Facial recognition entry pipeline,Wallet frameworks,CRM and event dashboards,On-ground scanning devices,Turnstile integrations,AI-driven fraud detection systems,App designs and user flows,Database structure and schemas,Architecture documentation,is the sole and exclusive property of FinkUP.,Users acquire no rights, license, ownership, or claims to any of the above.
23.2 Trademarks & Brand Assets
The following are protected trademarks of FinkUP:,“FinkUP”,“FinkCash” (Cashless System),“FinFace” (Facial Recognition System),“Connect by FinkUP”,“FinScan” (QR Scanning System),“FinKit” (Listing Panel),Any logos, icons, marks, trade dress, or branding associated with FinkUP,You may not:,Use,Copy,Reproduce,Imitate,Modify,Distribute,any FinkUP branding without express written permission.,Unauthorized usage constitutes infringement.
23.3 Copyright in Content on the Platform
All content made available on or through the FinkUP Platform is protected by copyright, including:,Text, copywriting, and articles,Images, graphics, banners,UI layouts,Illustrations and animations,Event templates,Marketing assets,Video creatives,Data visualizations,System messages and notifications,Legal documents and clauses,Event discovery formats,Ticket designs,You may not reproduce or use such content outside the Platform unless expressly permitted.
23.4 Prohibition on Reverse Engineering & Unauthorized Use
You agree NOT to:,Reverse engineer,Copy,Clone,Reproduce,Decompile,Decode,Disassemble,any part of:,Platform software,Ticketing systems,Anti-fraud mechanisms,QR tokenization technologies,APIs or SDKs,Wallet infrastructure,Turnstile or scanner integrations,Any attempt to do so constitutes a breach of this Agreement and may result in legal action.
23.5 No Rights Granted Except Limited Usage
Use of the Platform does not grant You:,Ownership rights,Rights to copy content,Rights to develop competing products,Rights to use trademarks,Rights to redistribute or sublicense FinkUP technologies,Rights to commercialize any part of the Platform,Only a limited, revocable, personal license to use the Platform is granted.
23.6 Event Organiser Content Rights
Event Organisers may upload:,Event names,Images,Artist names,Venue details,Lineups,Descriptions,Promotional content,Organisers represent that they have legal rights to upload such content.,FinkUP is not liable for content ownership disputes between Organisers and third parties.
23.7 User Content Submission Rights
If You submit any:,Reviews,Comments,Feedback,Ratings,Suggestions,Photographs,Uploaded content,You grant FinkUP a:,Perpetual,Irrevocable,Worldwide,Royalty-free,Sub-licensable,license to use, reproduce, distribute, modify, and publish such content across the Platform, social media, and marketing materials.,You waive all claims related to:,Attribution,Compensation,Control,Removal
23.8 Scraping, Data Harvesting & Automated Access Prohibited

23.10 Use of FinkUP API or Integration Components
If FinkUP provides API access:,Access must follow FinkUP documentation,Usage requires written permission,API keys must be protected,Rate limits must not be exceeded,APIs cannot be reverse engineered or cloned,Violation may lead to immediate revocation.
23.11 Intellectual Property of Event Organisers
Event-related IP, such as:,Artist photographs,Performances,Music,Lineups,Brands,Merch designs,remain the property of their respective owners.,FinkUP displays such content under authorized use.
23.12 Claims of Intellectual Property Infringement
If You believe Your IP has been infringed by content on the Platform, You must:,Provide written notice,Identify the infringing content,Provide proof of ownership,Request removal or correction,FinkUP may remove content as required by law.
23.13 Survival of IP Rights After Account Deletion
Even if:,You delete Your account,You stop using the Platform,You discontinue attending events,FinkUP retains:,All rights to content submitted,All rights to event media captured,All rights to Platform IP,IP rights do not expire upon account closure.
23.14 User Acknowledgment

24. USER-GENERATED CONTENT (“UGC”)
This section governs all content submitted by Users on the Platform, including but not limited to:,Reviews,Ratings,Comments,Feedback,Suggestions,Uploaded images or videos,Profile information,User-submitted descriptions,Social interactions (if enabled),All such content constitutes User-Generated Content (UGC).
24.1 User Responsibility for Content Posted
When You post UGC on the Platform, You agree that:,You are solely responsible for the content You submit,You own or have rights to publish such content,Content is accurate and truthful to the best of Your knowledge,Content does not violate any third-party rights,FinkUP does not pre-screen UGC and is not liable for anything You post.
You agree not to upload, share, publish, or transmit any UGC that is:,Abusive, defamatory, obscene, or offensive,Sexually explicit or suggestive,Pornographic or illegal,Hateful, racist, casteist, or discriminatory,Violent, harassing, or threatening,Misleading, fraudulent, or manipulative,Infringing upon copyrights/trademarks,Political propaganda,Spam or advertising of competing services,Malware or harmful scripts,Violating privacy rights of others,Any violation may result in:,Content deletion,Account suspension,Device blacklisting,Reporting to authorities,Permanent ban from FinkUP
24.3 License Granted to FinkUP
By submitting UGC, You grant FinkUP a:,Perpetual,Irrevocable,Worldwide,Royalty-free,Sub-licensable,Transferable,license to use, reproduce, modify, distribute, publish, broadcast, display, and create derivative works from Your content for:,Platform operations,Marketing & promotional materials,Event listings,Social media posts,UX/UI enhancements,Training of internal systems,You waive all rights to claim compensation or withdrawal of UGC.
24.4 FinkUP’s Right to Remove or Moderate Content
FinkUP reserves the right to:,Remove UGC without notice,Edit or modify UGC for clarity or compliance,Deny posting of specific content,Suspend or terminate the User account posting harmful content,Comply with court orders or law enforcement requests,Restrict content based on Organiser’s request,Apply automated or manual moderation,FinkUP is not obligated to:,Notify Users before removal,Justify moderation decisions,Restore deleted UGC,All moderation decisions are final.
24.5 No Endorsement of User Content
UGC posted on FinkUP:,Does not represent FinkUP’s views,Does not constitute endorsement,May not be factually accurate,Is the responsibility of the posting User,FinkUP disclaims all liability arising from UGC.
24.6 Review Manipulation Prohibited
Users may not:,Post fake reviews,Post reviews on events they did not attend,Offer or accept incentives for reviews,Manipulate ratings on behalf of Organisers or competitors,Use bots or fake accounts to boost ratings,Coordinate mass feedback manipulation,Violations may lead to:,Account termination,Legal action,Reporting to relevant authorities
24.7 Upload of Photos & Videos
If You upload photos or videos:,You must own the rights or have permission,You must not violate rights of performers, artists, or copyright owners,No recording of restricted areas, backstage, artist zones,No unauthorized live streaming,No uploading of offensive or illegal imagery,FinkUP is not liable for copyright claims arising from Your uploads.
24.8 Feedback, Suggestions & Product Ideas
Any suggestions You provide to FinkUP regarding:,Features,UI/UX,Improvements,Bug reports,Product ideas,Event experience enhancements,shall become the property of FinkUP.,FinkUP:,Is not obligated to compensate You,May use such suggestions freely,May develop products incorporating such ideas,You waive all rights to claim ownership or royalties.
24.9 Public Visibility of Content
UGC, including reviews and ratings, may be visible to:,Other users,Event Organisers,Venues,Search engines,Social platforms,Sponsors and partners,By posting, You acknowledge the public nature of such content.
24.10 Organiser-Created User Interactions
Some events may enable features such as:,Polls,Contests,Q&A sessions,Photo uploads,Live chat,Multi-user boards,UGC posted during such interactions is subject to:,Event rules,Organiser’s discretion,Platform moderation,FinkUP may remove contest submissions that violate rules.
24.11 Third-Party Liability Protection
If UGC posted by You results in legal claims by third parties (e.g., defamation, copyright infringement):,You agree to indemnify FinkUP,You will bear all legal costs,FinkUP may disclose Your contact details to authorities or claimants (as per law),FinkUP holds no liability for User misconduct.
24.12 No Expectation of Content Persistence
FinkUP does not guarantee that UGC will remain available.,UGC may be deleted:,When a User account is removed,During system upgrades,Due to event termination,Due to Organiser request,At FinkUP’s discretion,Automatically by archival logic,You cannot claim loss or compensation for removed content.
24.13 Reporting Mechanism for Harmful Content

25. TERMINATION, SUSPENSION & ACCOUNT ACTIONS
FinkUP may, at its sole discretion, suspend, restrict, limit, or terminate Your access to the Platform (including Your account, tickets, wallet balance, offers, and services) at any time, with or without notice, for reasons including but not limited to:,Policy violations,Fraud risk,Legal requirements,User misconduct,Account anomalies,Payment disputes,This section outlines all possible scenarios where FinkUP may intervene.
25.1 Grounds for Suspension or Termination
Your account may be limited, suspended, or terminated if You:,A. Violate Terms & Conditions,Breach any provision of these Terms,Fail to comply with Organiser or venue rules,Misuse the Platform or its features,B. Engage in Fraud or Suspicious Activity,Including:,Attempted duplicate entry,QR/ticket forgery,Selling or buying fraudulent tickets,Wallet manipulation,Identity fraud,Chargeback abuse,Using bots or scripts,Abnormal booking patterns,Suspicious refunds,C. Abuse of Offers, Discounts or Credits,Including:,Exploiting loopholes,Creating multiple accounts,Referring fake users,Redeeming promo codes fraudulently,D. Use Offensive, Threatening, or Illegal Content,In:,Reviews,Messages,Uploaded media,Event interactions,E. Misconduct at Events,Including:,Violence or harassment,Unauthorized recordings,Trespassing into restricted areas,Attempting to bypass entry systems,Misbehavior with staff or other attendees,F. Regulatory or Legal Requirements,FinkUP may suspend Your account if:,Requested by law enforcement,Required by court order,Needed for compliance with national regulations,Investigating illegal activity,G. 25.2 Nature of Account Actions

25.3 No Refund for Accounts Suspended Due to Misconduct
If Your account is suspended or terminated for any reason listed above:,No refund shall be issued,No compensation shall be provided,Tickets become automatically invalid,Add-ons become void,Offers and wallet credits may be forfeited,This includes:,Tickets for past events,Tickets for future events,Add-ons, merch, and coupons
25.4 Right to Withhold or Delay Payments
FinkUP may delay or withhold payments/refunds if:,Fraud investigation is underway,Chargeback or dispute is raised,Identity verification is pending,Ticket misuse is suspected,User behavior violates platform rules,Refund deadlines may be extended during investigations.
25.5 Requirement for Identity Verification
FinkUP may ask You to verify Your identity:,Before allowing high-value purchases,Before unlocking wallet withdrawal,Before restoring suspended access,Before allowing transfer of tickets,During fraud-risk cases,Verification documents may include:,Government ID,Selfie check,Phone or email OTP,Address proof,Payment method verification,Failure to verify may result in account restrictions.
25.6 Platform Integrity & Safety Enforcement
FinkUP may take proactive measures to:,Maintain integrity of ticketing system,Protect Organisers and attendees,Prevent scams and unauthorized resale,Ensure safety at events,This includes:,Canceling suspicious orders,Blocking bulk buyers,Disabling repeated refund abusers,Red-flagging high-risk accounts,Suspicious cluster detection using AI
25.7 Impact on Future Access
If Your account is terminated:,You may be permanently banned from FinkUP,You may not create new accounts,Device ID may be blocked,Attempts to bypass bans may lead to legal action,FinkUP may also:,Deny purchases for future events,Restrict entry even if User obtains ticket elsewhere,Report repeat offenders to Organisers and venues
25.8 Organiser-Requested Terminations
Organisers may request FinkUP to:,Cancel specific User tickets,Restrict access to certain attendees,Deny entry due to misconduct,Remove User profiles from event communities,FinkUP will comply with such requests at its discretion.
25.9 Event-Day Misconduct Consequences
If You violate event rules on the day of event:,Entrance may be denied,You may be escorted out,Wristband may be voided,Digital ticket may be disabled,No refund will be provided,Misconduct includes:,Violence,Abuse,Harassment,Intoxication,Safety hazards,Ignoring staff instructions,Attempting unauthorized entry
25.10 Technical Abuse & System Manipulation
Account action will be taken if You:,Attempt to bypass QR refresh logic,Clone or copy wristbands,Reverse engineer APIs,Use unauthorized applications,Interfere with scanning devices,Manipulate wallet transactions,This includes immediate account termination.
25.11 Appeal Process (Limited & Discretionary)
You may appeal certain account actions by:,Contacting customer support,Providing identity proof,Submitting explanation,FinkUP is not obligated to reverse any action.,Decisions are final.
25.12 No Liability for Termination
FinkUP shall not be liable for:,Loss of tickets,Loss of wallet balance,Loss of discounts or offers,Inability to attend events,Emotional or financial losses arising from termination,Termination is an operational necessity to protect the ecosystem.
25.13 User Acknowledgment
By using the Platform, You expressly acknowledge that:,FinkUP reserves the right to suspend or terminate accounts,Such actions may occur without prior notice,FinkUP’s decision is final and binding,No refunds or compensation will apply where misconduct is involved,FinkUP may act on Organiser or legal authority requests
26. GOVERNING LAW, DISPUTE RESOLUTION & JURISDICTION
This section governs the laws applicable to Your relationship with FinkUP, and outlines the processes for resolving any disputes arising from the use of the Platform, ticketing systems, or event experiences.
These Terms shall be governed by and interpreted in accordance with the laws of:,The Republic of India,
including applicable:,Information Technology Act, 2000,Indian Contract Act, 1872,Consumer Protection Act, 2019,Payment & Settlement Systems Act (if applicable),Intellectual Property Laws,Arbitration & Conciliation Act, 1996,Relevant state-specific event and entertainment regulations,No international laws shall apply.
26.2 Mandatory Arbitration Clause (Binding)
Except for matters involving:,Intellectual property violation,Fraud,Criminal activity,Emergency injunctions,ALL disputes between You and FinkUP shall be resolved through binding arbitration as per the Arbitration & Conciliation Act, 1996.,Arbitration Details,Arbitration shall be conducted by a sole arbitrator appointed by FinkUP.,Language of arbitration: English.,Venue of arbitration: Jaipur, Rajasthan, or any location designated by FinkUP.,Arbitration will be confidential and not open to public proceedings.,The arbitral award shall be final and binding on both parties.
26.3 No Class Actions or Group Litigation
You agree that:,Disputes shall be resolved individually,Class-action lawsuits, representative actions, or collective claims are not permitted,You may not join Your claim with claims of other Users,This significantly restricts exposure to mass litigation.
26.4 Pre-Arbitration Notice Requirement
Before initiating arbitration, You must:,Send a written notice to FinkUP,Clearly describe the issue,Provide booking details and supporting documents,Allow FinkUP 30 days to attempt resolution,Only after this period may arbitration begin.
26.5 Jurisdiction for Non-Arbitrable Matters
For disputes not subject to arbitration (e.g., IP infringement), the courts having jurisdiction shall be:,Courts of Jaipur, Rajasthan, India
- and no other court shall have jurisdiction,,regardless of:,Your location,Event location,Where the ticket was purchased,Where the issue occurred,This ensures FinkUP is not dragged into multiple state jurisdictions.
26.6 Limitation on User Claims
You must file any claim or dispute within 12 months from the date the cause of action occurs.,Claims filed after this period are permanently barred.
26.7 Costs & Fees of Arbitration
Unless otherwise determined by the arbitrator:,Each party shall bear its own legal fees,Arbitration costs may be split equally,If Your claim is found frivolous, You may be required to pay FinkUP’s legal fees,This discourages baseless disputes.
26.8 Exception for Organiser-User Disputes
If Your dispute is with the Organiser (not FinkUP), including:,Event experience,Safety or misconduct incidents,Venue issues,Cancellation policies,Refund decisions,Artist lineup changes,FinkUP shall:,Not be made a party to the dispute,Not be liable for Organiser actions,Not be required to arbitrate on Organiser’s behalf,You must resolve such matters directly with the Organiser.
26.9 Disputes Involving Payment Gateways or Banks
If a dispute pertains to:,Payment failures,Duplicate payments,Chargebacks,Card issuer disputes,UPI or bank issues,FinkUP may:,Redirect You to the payment gateway,Request supporting documents,Wait for bank and gateway resolution timelines,FinkUP is not liable for delays caused by banks or payment processors.
26.10 Injunctions & Interim Relief
FinkUP reserves the right to seek:,Interim relief,Temporary restraining orders,Injunctions,to prevent:,Fraud,IP infringement,Platform misuse,Data scraping,Security breaches,Without needing arbitration first.
26.11 Severability of Arbitration Clause

FinkUP shall not be liable for any failure, delay, cancellation, suspension, or interruption in providing services caused by events beyond its reasonable control, including but not limited to:,Natural disasters (floods, earthquakes, storms, cyclones),Fire, explosion, building collapse,War, armed conflict, terrorism, riots, protests,Government restrictions, curfews, lockdowns,Epidemics, pandemics, health advisories,Labour strikes or industrial disputes,Internet outages, telecom failures,Power failures at venue or infrastructure collapse,Failure of third-party service providers,Act of God or unforeseen emergencies,In such circumstances:,No refunds are guaranteed,FinkUP may modify or suspend services,Organisers may reschedule or cancel events,FinkUP bears no financial or legal liability
If any provision of these Terms is held to be:,Invalid,Unenforceable,Illegal,by a court or arbitrator, then:,That specific clause shall be severed,Remaining provisions shall continue in full force,The invalid portion may be modified only to the extent necessary to make it enforceable

All notices from FinkUP may be delivered through:,Email,SMS/WhatsApp,Push notifications,In-app messages,Updates posted on website,System banners,You agree that:,Such communications constitute valid notice,You are responsible for keeping Your contact information up-to-date,User notices to FinkUP must be submitted via:,Official support channels,Registered email,Legal notice address published in T&C,No notice sent via social media is considered valid.
This Agreement:,Constitutes the complete and exclusive understanding between You and FinkUP,Supersedes all prior communications, representations, or understandings,Includes all policies referenced within (Refund Policy, Privacy Policy, Shipping Policy, etc.),Applies to all Users, unless superseded by Organiser-specific agreements,No oral or informal statements modify these Terms.
27.8 Survival of Certain Provisions
Even if You:,Delete Your account,Stop using the Platform,Are banned or suspended,Discontinue event participation,The following sections shall survive termination:,Payments & Refunds,Wallet Rules,Privacy & Data Rights,Intellectual Property,Indemnity,Limitation of Liability,Dispute Resolution & Arbitration,User-Generated Content License,These remain enforceable indefinitely.
27.9 Third-Party Beneficiaries
Except where explicitly stated:,No third party has rights under these Terms,Organisers, vendors, sponsors, and performers are not parties to this Agreement,FinkUP is not liable for third-party obligations or actions
27.10 Headings & Interpretation
Section headings are for convenience only,They do not affect interpretation,The singular includes plural and vice versa,Words such as “including” mean “including without limitation”
These Terms may be translated to other languages for convenience.,However:,The English version shall govern,In case of conflict, the English version prevails
27.12 Continuity of Service Disclaimer
FinkUP does not guarantee that:,Services will always be available,All features will remain indefinitely,Legacy features will be supported,Older tickets will be compatible with new systems,FinkUP may evolve, upgrade, modify, or discontinue features at any time.
27.13 Grievance Redressal (Mandatory Under IT Act)
A Grievance Officer shall be appointed by FinkUP in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.,Details will be published separately in the Privacy Policy.
27.14 User Acknowledgment
By using the Platform, You expressly acknowledge that:,Force Majeure protections apply,Severability preserves the enforceability of the Agreement,No waiver is implied unless written,Only English version of these Terms is binding,You accept all methods of communication from FinkUP,All related policies form an integrated Agreement
28. LIMITATION OF LIABILITY
To the fullest extent permitted by law, FinkUP, its parent company, subsidiaries, affiliates, directors, employees, agents, partners, licensors, vendors, and service providers (“FinkUP Parties”) shall not be liable for any losses or damages arising out of or in connection with:,Use of the Platform,Purchase or use of tickets,Event attendance,On-ground device systems,Wallet usage,Add-ons or merchandise,Organiser policies,Third-party service failures,Access control systems,Safety incidents,Technical disruptions,This limitation applies regardless of whether claims are based on:,Contract,Tort,Negligence,Strict liability,Statute,Equity,Any other legal theory
28.1 No Liability for Organiser, Venue or Performer Actions
FinkUP is not responsible for:,Event quality,Performer delays or cancellations,Sound, lighting, production issues,Staff behaviour (security, volunteers, vendors),Venue conditions, cleanliness, safety,Crowd behaviour, mismanagement, stampedes,Alcohol-related incidents,Food poisoning or vendor issues,Parking availability or safety,Lost belongings at venue,These are obligations of the Organiser or Venue, not FinkUP.
28.2 No Liability for Event Experience or Disruptions
FinkUP shall not be liable for:,Poor visibility or blocked views,Overcrowding or limited seating,Long queues,Event rescheduling or changes,Suboptimal acoustics or production,Artist no-shows,Weather-related disruptions,Event delays or early closure,Event cancellation due to external circumstances,Refund decisions in such cases are made solely by the Organiser.
28.3 No Liability for Personal Injury or Safety Incidents
FinkUP is not liable for:,Injury, harm, or accidents,Medical emergencies,Slip-and-fall incidents,Physical altercations or harassment,Damage to clothing or personal property,Loss, theft, or misplacement of belongings,Evacuation procedures,Venue safety and security are responsibilities of the Organiser.
28.4 No Liability for Technical Failures
FinkUP is not liable for failures resulting from:,App crashes,QR not loading,Delayed OTPs or emails,Payment gateway outages,Network connectivity issues,Hardware malfunction at entry gates,Wristband chip failure,FR mismatch or scanning delays,Offline sync delays at multi-gate venues,Technical systems inherently carry operational limitations.
28.5 No Liability for Wallet Issues
FinkUP is not responsible for:,Wallet balance loss due to User negligence,Incorrect top-ups,Expired balances,Failed transactions due to vendor terminals,Delay in refund processing,Frozen wallets pending fraud checks,Refunds depend entirely on Organiser policies.
28.6 No Liability for Acts of Users or Third Parties
FinkUP is not liable for:,User misconduct,Harassment or violence by other attendees,Fake tickets purchased outside the platform,Unauthorized resale,Fraud by third-party ticket sellers,Damages caused by vendors, sponsors, or performers,FinkUP only facilitates transactions; it does not guarantee behaviour of attendees or third parties.
28.7 No Liability for Loss of Enjoyment, Emotional Distress, or Expectations
Users cannot claim damages for:,Loss of enjoyment,Emotional distress,Disappointment with event quality,Dissatisfaction with performers,Change in lineup or event flow,Event popularity exceeding expectations,Event experience is subjective and outside FinkUP’s control.
28.8 Maximum Liability Cap
To the maximum extent permitted by applicable law:,FinkUP’s total cumulative liability shall never exceed the total amount paid by the User to FinkUP for the specific booking in dispute.,This means:,No punitive damages,No special damages,No indirect losses,No consequential damages,No business or economic losses,No damages exceeding the face value of the ticket or add-on,This cap applies even if:,FinkUP has been advised of the possibility of damages,The remedy fails of its essential purpose
28.9 No Liability for Indirect, Special or Consequential Damages
FinkUP shall NOT be liable for:,Lost profits,Lost revenue,Lost data,Loss of goodwill,Loss of business opportunities,Lost travel or accommodation costs,Damages relating to third-party decisions,Reputational damages,Incidental losses,Such damages are expressly disclaimed.
28.10 No Liability for Force Majeure
As per Section 27.1, FinkUP is not liable for interruptions caused by events beyond its control, including:,Natural calamities,Government restrictions,Internet/telecom failures,Systemic outages,War, riots, political unrest,Pandemic, epidemic or public health emergency,Venue structural issues,Organiser bankruptcy or non-performance
You agree to indemnify and hold harmless FinkUP from any claims, losses, liabilities, and expenses arising from:,Your breach of these Terms,Your violation of law,Your misconduct at events,Your misuse of the Platform,Third-party claims related to Your actions,Fraudulent or suspicious activity from Your account,FinkUP may assume exclusive defence at Your expense.
28.12 Basis of the Bargain
You acknowledge that:,These disclaimers and limitations form the essential basis of the agreement,Without these limitations, FinkUP could not offer services at the current pricing structure
28.13 User Acknowledgment
By using the Platform, You expressly acknowledge and agree that:,FinkUP’s liability is strictly limited,Refund decisions belong to the Organiser,FinkUP is not responsible for event operations,Damages are capped at the booking amount,Negligence by third parties is outside FinkUP’s responsibility,No emotional or indirect damages may be claimed

29.2 Procedure for Filing a Grievance
To lodge a formal grievance, the User must:,Send a written complaint to the GRO via the contact details provided above.,Include the following mandatory details:,Full name,Registered phone number and email address,Order ID or transaction reference (if applicable),Date and description of issue,Supporting evidence (screenshots, communication logs, documents),Incomplete complaints may result in delays.

29.5 Customer Support (Non-Legal Queries)
For general support, Users may contact:,FinkUP in-app support,Customer care email,Automated helpdesk chat,FAQs and guides available on the Platform,These channels are for non-legal or day-to-day assistance.
